Buyer agrees that ALL DOMAIN SALES ARE FINAL.
PAYMENTS
Credit Card & Paypal– Buyer acknowledges that we maintain detailed records of all transactions and examples of such records are ip address, pages visited, and similar, but we do not maintain any credit card information since that is handled by our payment processor (Stripe) for your security. Buyer acknowledges that we are able to provide the Buyer’s credit card company or Paypal with definitive proof that Buyer has received and is in full control of said Domain(s).
Escrow.com – Buyer agrees to complete payment for the Domain(s) selected for purchase within 24 hours of being notified that the Escrow.com transaction is ready for them to agree and submit payment. Buyer is responsible for complying with all Escrow.com payment requirements. Buyer is responsible for all Escrow.com fees.
Bank Wire – Buyer agrees to complete payment for the Domain(s) selected for purchase within 72 hours from cart checkout. Buyer is responsible for all bank-related fees prior to our bank receiving their payment (overseas bank wire payments sometimes require additional intermediary bank fees that are outside of our control).
TERMS
Buyer agrees to pay the Total Price listed for the Domain(s) selected for purchase. DomainVIP.com agrees to email Buyer detailed instructions (including a password or registry key) for permanently transferring control of the Domain(s) within 72 business hours of cleared payment from Buyer. Buyer understands that clearing a payment can take several days or more and we will not transfer ownership until the payment is fully cleared. Should there be a delay in the transfer process for any reason, DomainVIP.com will notify Buyer using email or phone of the transfer status. Buyer acknowledges that the transfer process for the Domain(s) must comply with ICANN accreditation policies and procedures, which can be found at www.icann.org. To the extent allowed by the law, Buyer agrees to indemnify and hold DomainVIP.com harmless from any and all liability or claims or controversies that may arise due to the sale of the Domain(s) or which may arise out of or in connection with this agreement. DomainVIP.com and Buyer both represent to the other that it has full authority to enter into this agreement and perform its terms. Buyer agrees to take control of the Domain(s) within 7 days of the sale. Buyer acknowledges it is solely responsible for renewing the Domain registration(s) with the registrar of record prior to the expiration date listed in “WHOIS”. The registrar of record can be determined by searching at www.networksolutions.com/whois.
You represent that you do not hold or assert any Trademark, copyright, or other intellectual property right in or to the domain name, or any portion thereof, that is the subject of this Agreement. In the alternative, if you do now or intend to in the future hold or assert such rights, you do on your own behalf and on behalf of any person who you represent hereby waive such claims and release WebFizz, Inc. and its parents, subsidiaries, successors, assigns, attorneys, contractors, agents, employees, officers, directors, shareholders, and affiliates from any and all claims arising from such rights. To the extent that such waiver and release of claims is determined to be invalid in whole or in part for any reason, you agree that your remedy in any dispute with DomainVIP.com shall be limited to return of the price you paid for the domain name that is the subject of this agreement.
Buyer represents that it does not act on behalf of any other person asserting such rights.
DomainVIP.com reserves the right to rescind and/or make null and void the sale of Domain(s) if Buyer fails to take control of the Domain(s), in accordance with the instructions provided, within 90 days of the sale of the Domain(s). ALL DOMAIN SALES ARE FINAL and subject to prior sale. No refunds will be provided if Buyer fails to take ownership and ownership of the Domain(s) will revert to DomainVIP.com and they will be re-listed for sale.
All physical correspondence to DomainVIP.com should be addressed to WebFizz, Inc., Attn: DomainVIP.com, 11654 Plaza America Dr, Suite 139, Reston, VA 20190. This agreement is subject to the laws of the State of Virginia. Buyer agrees to waive questions of jurisdiction and venue and agrees that all disputes brought by Buyer shall be in the courts of Fairfax County, Virginia.
